Welcome to Imua Ohana. By accessing this website, booking services, participating in experiences, renting equipment or property, purchasing products, artwork, merchandise, or engaging with Imua Ohana in any way, you agree to the following Terms of Service.
If you do not agree to these terms, please do not use our website, services, or participate in any Imua Ohana activities.
1. ACCEPTANCE OF TERMS
By using this website or any services provided by Imua Ohana, you acknowledge that you:
- Are at least 18 years old or have parental/guardian consent
- Understand the inherent risks associated with ocean activities and outdoor experiences
- Agree to comply with all rules, policies, and safety instructions
- Accept these Terms of Service in full
2. SERVICES PROVIDED
Imua Ohana may provide:
- Surf lessons
- Ocean experiences
- Guided adventures
- Rentals
- Retreats
- Coaching
- Events
- Merchandise
- Artwork
- Digital content
- Media and storytelling experiences
- Lodging or hosted accommodations
- Other wellness or recreational services
All services are subject to availability and may change at any time without notice.
3. ASSUMPTION OF RISK
Participation in ocean, surf, travel, outdoor, wellness, and physical activities involves inherent risks including but not limited to:
- Injury
- Drowning
- Equipment failure
- Ocean hazards
- Wildlife encounters
- Changing weather conditions
- Physical exertion
- Property damage
- Illness or death
By participating in any Imua Ohana activity, you voluntarily assume all risks associated with participation.
You agree that you are physically capable of participating and will notify Imua Ohana of any relevant medical concerns prior to participation.
4. RELEASE OF LIABILITY
To the fullest extent permitted by law, Imua Ohana, its owners, instructors, contractors, affiliates, employees, partners, and representatives shall not be held liable for:
- Personal injury
- Death
- Property loss or damage
- Theft
- Accidents
- Delays
- Travel interruptions
- Ocean conditions
- Weather conditions
- Third-party actions
- Emotional distress
- Financial losses
Participation is entirely voluntary and at your own risk.
5. BOOKINGS, PAYMENTS & REFUNDS
All bookings, deposits, purchases, and reservations are subject to the Imua Ohana Return, Cancellation & Refund Policy.
All deposits are non-refundable.
No refunds will be issued for:
- Cancellations
- No-shows
- Late arrivals
- Unused services
- Early departures
- Weather conditions deemed safe for operation
- Violations of property or conduct rules
Imua Ohana reserves the right to refuse service to anyone at any time.
6. RENTALS, PROPERTY RULES & GUEST CONDUCT
Imua Ohana maintains a respectful, peaceful, family-oriented environment.
The following are strictly prohibited:
- Illegal drug use
- Excessive intoxication
- Parties
- Unauthorized gatherings
- Destructive behavior
- Harassment or abusive conduct
- Aggressive or threatening behavior toward guests, staff, instructors, neighbors, or tenants
No abusive behavior between guests staying together, or toward anyone on property, will be tolerated.
Only approved guests included in the booking are allowed on the property unless otherwise authorized in writing.
Violation of these rules may result in:
- Immediate removal from the property
- Cancellation of services
- Permanent banning from future bookings
- Additional charges for damages
No refunds will be issued if removal occurs due to policy violations.
7. RENTAL EQUIPMENT RESPONSIBILITY
Guests assume full responsibility for all rental equipment during the rental period.
You agree to return all equipment in the same condition received.
You may be charged for:
- Damage
- Theft
- Loss
- Negligence
- Excessive wear
- Late returns
Imua Ohana is not responsible for injuries resulting from misuse of rental equipment.
8. ARTWORK, MERCHANDISE & SHIPPING
All sales are final unless otherwise stated.
ONCE AN ITEM HAS BEEN SHIPPED AND TRACKING INFORMATION HAS BEEN PROVIDED, IMUA OHANA RELEASES ALL LIABILITY, RESPONSIBILITY, AND OWNERSHIP OF THE PACKAGE.
IMUA OHANA IS NOT RESPONSIBLE FOR LOST, STOLEN, DELAYED, MISDELIVERED, OR DAMAGED PACKAGES AFTER THEY LEAVE OUR POSSESSION.
Customers are responsible for working directly with the shipping carrier regarding delivery issues.
While Imua Ohana may attempt to assist when possible, replacements, refunds, or reimbursements are not guaranteed once shipment has occurred.
9. MEDIA RELEASE
By participating in Imua Ohana experiences, you grant permission for photos, videos, audio, and media captured during participation to be used by Imua Ohana for:
- Marketing
- Social media
- Promotional campaigns
- Website content
- Storytelling
- Brand partnerships
without compensation unless otherwise agreed upon in writing.
If you wish to opt out of media usage, written notice must be provided prior to participation.
10. WEBSITE USE
You agree not to:
- Misuse the website
- Attempt unauthorized access
- Copy or reproduce content without permission
- Use Imua Ohana branding without written consent
- Engage in fraudulent activity
All website content, branding, artwork, logos, photos, and media remain the intellectual property of Imua Ohana unless otherwise stated.
11. THIRD-PARTY SERVICES
Imua Ohana may work with third-party companies, platforms, instructors, guides, travel providers, or payment processors.
We are not responsible for:
- Third-party errors
- Travel interruptions
- Payment processor issues
- External websites or services
- Third-party conduct
Use of third-party services is at your own risk.
12. RIGHT TO REFUSE SERVICE
Imua Ohana reserves the right to refuse or terminate service, bookings, rentals, participation, or access to any individual for any reason deemed necessary for the safety, integrity, or well-being of the community, business, staff, or guests.
13. GOVERNING LAW
These Terms of Service shall be governed and interpreted in accordance with the laws of the State of Hawaii, without regard to conflict of law principles.
14. CHANGES TO TERMS
Imua Ohana reserves the right to update or modify these Terms of Service at any time without prior notice.
Continued use of the website or services after changes are posted constitutes acceptance of those updated terms.
